Terms of Service
Last Updated: March 2025
Please read these Terms of Service carefully before requesting or scheduling services from Plumbworks Plumbing & Rooter. By contacting us, scheduling a service appointment, or allowing our technicians onto your property, you agree to be bound by these terms.
1. Acceptance of Terms
By using the services of Plumbworks Plumbing & Rooter (“Company,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to these Terms of Service in full. If you do not agree to these terms, you must not request or use our services.
These terms apply to all customers, visitors, and others who access or use our services, whether through our website at callplumbworks.com, by phone, or through any other means of contact.
2. Services Provided
Plumbworks Plumbing & Rooter provides residential and commercial plumbing services, including but not limited to: drain cleaning, rooter services, leak detection and repair, pipe installation and replacement, water heater services, fixture installation, sewer line services, and general plumbing maintenance and repairs.
All work is performed by licensed, insured plumbing professionals in accordance with applicable California plumbing codes and regulations. We reserve the right to refuse service at our discretion, including situations where conditions are deemed unsafe or where the scope of work falls outside our area of expertise.
Quotes and estimates provided prior to work are based on the information available at the time of assessment. Final charges may vary if unforeseen conditions are discovered during the course of work. We will communicate any material changes to scope or cost before proceeding.
3. Scheduling & Cancellations
Service appointments are scheduled based on availability. Appointment windows are estimates; we make every effort to arrive within the scheduled window but cannot guarantee exact arrival times due to the nature of service work.
If you need to cancel or reschedule an appointment, please notify us as soon as possible and no later than 24 hours before your scheduled appointment time. Cancellations made with less than 24 hours’ notice may be subject to a cancellation or trip fee at our discretion.
For emergency or same-day service calls, additional fees may apply. We reserve the right to cancel or reschedule appointments due to circumstances beyond our control, including but not limited to severe weather, vehicle issues, or prior job overruns. In such cases, we will notify you promptly and reschedule at no additional charge.
4. Payment Terms
Payment is due upon completion of service unless other arrangements have been made in writing in advance. We accept cash, check, and major credit cards. Returned checks are subject to a returned check fee.
For larger projects, a deposit may be required prior to scheduling or commencement of work. The deposit amount and terms will be stated in your written estimate or proposal.
Invoices not paid within 30 days of the service date are considered past due and may be subject to a late payment charge of 1.5% per month (18% annually) on the outstanding balance. Customers are responsible for any collection costs, including reasonable attorney’s fees, incurred in the collection of overdue amounts.
All prices are subject to change without notice. The price quoted at the time of your service agreement will be honored for that service, provided work commences within the agreed timeframe.
5. Warranties & Limitations
We warrant our labor for a period of 30 days from the date of service completion, unless otherwise stated in writing. Parts and materials are subject to the manufacturer’s warranty, which we will assist you in processing to the extent possible.
Warranties are void if repairs or modifications are made to our work by another party, if damage results from misuse, neglect, or abuse, or if conditions outside the scope of our original work cause or contribute to failure.
Drain cleaning and rooter services are warranted to clear the specified obstruction at the time of service. We cannot warrant against future blockages, root intrusion, or recurring issues caused by pipe condition, root growth, or customer behavior.
Our warranties are limited to re-performance of the work or, at our sole discretion, a refund of the amount paid for the affected service. We do not warrant against pre-existing conditions or issues unrelated to the work performed.
6. Liability Disclaimer
To the fullest extent permitted by applicable law, Plumbworks Plumbing & Rooter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to loss of use, loss of profit, property damage not caused by our direct negligence, or personal injury.
Our total liability for any claim arising from services rendered shall not exceed the total amount paid by the customer for the specific service giving rise to the claim.
We carry general liability insurance and workers’ compensation insurance as required by the State of California. Proof of insurance is available upon request. We are not responsible for pre-existing damage, concealed conditions, or damage caused by deferred maintenance discovered in the course of our work.
The customer is responsible for disclosing all relevant information about the property, including the location of utilities, pipes, and any known hazardous conditions, prior to the start of work. We are not liable for damage resulting from undisclosed or unknown conditions.
7. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under or related to these terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Riverside County, California.
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, unless the claim qualifies for and is brought in small claims court.
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
